Bali Villas and More Terms and Conditions

Bali Villas and More (BVAM) is an Australian owned PTY LTD. We are an online travel agency.  By using BVAM services you, as the Guest, agree to the following Terms and Conditions between BVAM, Villa Owners and other service providers and yourselves.

  1. Booking Procedure
    1. Upon confirmation that you wish to book a particular villa, we will arrange with the villa owner or representative to hold your booking for the required dates for a period of 3 days.
    2. During this 3-day period, you are required to pay the deposit (See Point 2).
    3. Upon receipt of the deposit we will confirm the booking with the villa owner or their representative.
    4. In the event of non-payment of the deposit within the 3-day period, the booking may be null and void or made available to other interested parties until your deposit is received.
    5. For bookings made using the live booking feature, there is a time delay to confirm booking and availability. If the selected villa is not available, an alternative will be offered or customers offered a full refund on monies paid. In the case of an alternative villa being offered, any difference in price will be the responsibility of the customer. If the new villa is cheaper than the original booked villa, then the difference will be refunded, or put towards the final payment.
    6. For hotel bookings, bookings are confirmed upon receipt of full payment from guests. Hotel Vouchers are issued to guests as confirmation of booking.
    7. We do our best to be accurate with prices displayed, and are correct to the best of our knowledge. However, final prices will be provided upon enquiry due to the dynamic nature of the market, currency exchange fluctuations etc.
  2. Payment of Deposits and Fees.
    1. If your booking is made more than 60 days before the rental period, a deposit of 50% is payable.
    2. If your booking is made less than 60 days before the rental period, 100% of the fee is payable at the time of booking.
    3. For bookings made more than 60 days before the rental period, the remaining 50% must be paid not less than 30 days from the start of the rental period.
    4. If the outstanding balance is not paid within the timeframes as stipulated in Article 2.3, the villa owners reserve the right to cancel the booking. Deposits paid are non-refundable.
    5. Invoices will be sent online and can be paid by bank transfer or credit cared via our secure online payment gateway.  Credit Card, or Transaction fees are as follows VISA/MCARD 1.2% ;Premium/Platinum/GOLD- VISA/MCARD 1.95% ;All AMEX Cards 1.95% ; Diners Club 2.5% ; All INTL Card types 3%. Please note that there are no fees for online bank transfers between Australian banks.
    6. Security bond arrangements are made with individual villa owners/ their representatives, and Guests will be made aware of this through the specific villa’s Terms and Conditions, which will be sent at the time of booking.
    7. Additional taxes may be payable to the displayed villa fee. These may vary from villa to villa and will be confirmed at the time of enquiry/ booking.
    8. Extra beds may incur an additional charge. If you require an extra bed and an additional charge is payable, you will be invoiced separately for this, if using the ‘Book Now’ feature on the website.
    9. Prices displayed may vary slightly on the day of booking due to currency exchange rate fluctuations. The invoice amount will reflect the currency exchange rate on the date of issue.  Currency conversion rates are dictated by our banking partner  Westpac Australia and are available on http://www.westpac.com.au/personal-banking/services/currency-converter/  Invoices will be issued based on the exchange rate of the day of issue
    10. Prices are subject to change without notice and will be confirmed on the day of booking. BVAM does all that is reasonable to ensure information contained on the website is accurate and up to date. If BVAM is notified of a change of price by villa owners/ managers at the time of booking the Guest will be informed. BVAM holds no liability for differences in prices.
    11. Customers using the TravelPay Layby Interest Free Payment option, are subject to the TravelPay customer terns and conditions which can be found here: http://www.travelpay.com.au/wp-content/uploads/2015/10/TravelPay-CustomerTermsConditions.pdf
    12. Layby options are available for 2, 3, 4, 5, 6, or 10 months. Each lay by has a cost of 2.5% credit card fee in card is in Australia or 3% if outside Australia and $100 application fee or $200 application fee if 10 months lay by is selected. All payments made by layby must be fully refundable. Therefore, the number of months you can Layby for will depend on the refund policy of the particular villa. Layby payments must be completed be completed before the deadline for for refunds for a villa. For example, if a villa requires a 60-day notice period to cancel with penalties, your final layby payment must be made before this date. If a villa does not offer a refund, layby payments are not available for this villa.
    13. If there is a difference in payment terms and conditions between those contained herewith and the payment Terms and Conditions of an individual, the Terms and Conditions of a particular villa will supersede Bali Villas and More Terms and Conditions.
    14. For hotel bookings, the full amount is payable at the time of booking to secure your booking. Cancellation policies vary and it is the clients responsibility to request relevant information regarding this from Bali Villas and More at the time of booking.
  3. Amendments, Cancellation and Refunds
    1. If fees due are not paid within the timeframes as stipulated in Article 2, the villa owners reserve the right to cancel the booking. Deposits paid are non-refundable.
    2. Cancellation and refund policies sometimes vary depending upon the villa booked. These are outlined in the individual villa’s Terms and Conditions, which are available upon request.
    3. Any amendments will incur an administration fee, which varies according to individual circumstances. Any reduction in the booking period is considered a partial cancellation and subject to relevant Terms and Conditions for the particular villa booked.
    4. Where any refunds are paid, additional banking fees are the responsibility of the Guest.
    5. If the villa the client wishes to book becomes unavailable during the time it takes for payment to be processed, wherever possible a similar villa be offered. Any additional fees are the responsibility of the guest.
  4. Functions and Additional Fees
    1. If you wish to hold a function at the villa, such as parties, weddings or other events, which include music or live entertainment and outside guests you need to tell us so that arrangements can be made with the Banjar (village leaders). Additional fees will be applicable which, are the responsibility of the Guest.
    2. If you decide to hold such a function during your stay, you will need to speak to your villa staff. Additional fees will be applicable which, are the responsibility of the Guest.
    3. Guests are responsible for the payment of fees associated with any additional items – such as swimming pool fences, cars, motorbikes, furniture etc. – or services – such as chefs, message etc.
  5. Villa Check In and Check Out
    1. Check is time is generally from 2:00pm and check out at 12:00 noon.  Late departure is dependant upon villa availability. Late checkouts until 6:00pm may be charged at 50% of the daily rate. Any check out after this time is considered an additional day.
  6. Pool Fences
    1. Pool fencing is not a mandatory requirement under Indonesian Law, and is not a standard inclusion.
    2. Pool fencing is available at an additional cost. The safety of all persons, including children, remains the sole responsibility of the villa guests.
  7. Complaints
    1. Any issues should be raised with villa staff at the time they occur during the stay and BVAM kept informed.
    2. BVAM will not enter into discussion regarding complaints regarding matters of which the company was not informed at the time of the matter arising.
    3. The resolution of any issues is between the Guest and Villa Owner/ their Representative according to the individual Terms and Conditions for the specific villa booked.
  8. Package rates
    1. All BVAM Prices are inclusive of tax, service and other charges and inclusive of stated extras, including but not limited to airport transfers and promotional extras and discounts that will vary from time to time.  Non-package rates are available on request.
    2. Airport transfers are included on the following basis: Minimum stay of 3 nights – one, one-way pick up from the airport. Minimum stay of 5 nights – one airport pick up and one airport drop off. This applies to bookings in the Kuta, Legian, Seminyak, Canggu, Nusa Dua and Jimbaran areas. For bookings in other areas of the island, discounted transfers will be offered. This will be confirmed at the time of booking.
    3. Usually one vehicle per booking will be provided for airport transfers, or more depending upon the most economical ad efficient way of organising transfers. For large group bookings, where guests are arriving on multiple flights, it may be necessary for guests to wait for other guests at the airport, or additional charges may be made for additional transfer vehicle.
    4. Airport transfers may not be included in hotel accommodation option packages, minimum booking spend applies.
    5. Transfers are not included for accommodation in Nusa Lembongan, but may be arranged for an additional fee.
  9. Flight Bookings
    1. BVAM operates as a booking agent only for flights, and books flights on behalf of Guests if requested.
    2. Due to frequent changes in flight prices, any flight prices quoted are valid for a period of 24 hours only. Any changes in prices after this will be charged at the guest’s expense.
    3. If flights are included as part of layby payment plans, and there is a change in flight price between application and approval of layby payments, the guest is responsible for the increase in fare price. Any increase in flight fares is payable immediately and may not be added to the layby payment.
    4. Flight bookings will only be confirmed up receipt of full payment from guests.
    5. Guests are responsible for the accurate provision of passenger information to BVAM for flights to be booked.
    6. BVAM holds no liability for any issues arising from the incorrect submission of information from the Guest.
    7. Any changes to flight bookings will be subject to Change Fees as set by the particular airline used.
    8. Guests are also subject to the terms and conditions, including Terms of Carriage as laid out by the particular airline being used.
  10. Hotels
    1. Hotel prices displayed on the website are guide prices only. Exact price will be confirmed upon enquiry, and may vary depending upon season and availability.
    2. Pictures are for illustration purposes. The room you receive may vary slightly to the pictures of the rooms displayed.
    3. Cancellation and/ or changes will be subject to fees specified by individual hotels and also subject to a BVAM admin fee.
    4. In the event of changes to prices for hotel rooms between the time of the quote being issued, and the client confirming the booking, the client is responsible to pay any increases in fees. Bali Villas and More holds no obligation to honour the cheaper rates quoted if these have increased by the time of client booking.
  11. Limitation of liability
    1. BVAM acts as a marketing and booking agent only. We sell villa and hotel accommodation, and extras, including but not limited to transfers and tour options on behalf of villa owners, villa management companies and other providers.  BVAM’s obligation is to make villa or other types of accommodation bookings on your behalf and to arrange relevant contracts between you and the accommodation provider, and other services.
    2. BVAM has no responsibility or liability for these services nor do we make any warranty or representation regarding the standard of the accommodation, or other services.  All bookings are made subject to the terms and conditions and limitations of liability imposed by these accommodation or other service providers. BVAM will do all that is reasonable to ensure your choice of accommodation or other service is as requested. If for any reason, any accommodation provider is unable to provide the accommodation for which you have contracted, or other services differ, your remedy lies against the provider and not BVAM.
    3. BVAM provides no guarantee regarding the operating and safety procedures of external tour operators. By booking a tour through BVAM, you acknowledge that such matters rest with the tour operator and yourself. At no time does BVAM accept any responsibility or liability for personal safety or personal injuries.
    4. By booking a tour you acknowledge that you have read and understood the full terms and conditions in relation to tour booking and safety and absolve Bali Villas and More PTY LTD of any and all responsibility and liability for personal safety whilst undertaking activities booked through BVAM. You herby understand that by participating in any tours or other activities, you are doing so at your own risk.
    5. It is the guests’ responsibility to ensure that they are in compliance with all visa and other such regulations for travel to Indonesia, including passport validity of at least 6 months from the end of their travel period to Indonesian. BVAM holds no responsibility for any losses incurred by guests due to failure of guests to meet any and all regulations in this matter.
    6. It is strongly recommended that all travels are covered by adequate travel insurance.
